Terms and Conditions

Interpretations

For the purpose of these conditions, the Company shall be deemed as to refer to M6 Pro Audio. The Customer hereinafter shall refer to any Company, Partnership or individual who shall enter into any agreement with M6 Pro Audio. This contract shall be governed under the terms of English Law.

Conditions of Hire and/or Services

Duties of the Company

  1. The Company agree to hire and the Customer agrees to take the equipment and/or services subject to the terms and conditions set out in these conditions.
  2. All equipment remains the property of the Company.
  3. The period of hire shall commence upon the collection by the Customer or on delivery by the Company to the Customer and will be terminated upon the collection or return of the equipment.
  4. The Company shall NOT incur any liability whatsoever in the event of any delay caused or failure of equipment.

Customer Duties

  1. During the period of hire, the equipment is the sole responsibility of the Customer who shall be held completely liable for any loss or damage. Similarly, the Customer must undertake responsibility for insuring the equipment against all risks to the equipment to the full replacement value thereof.
  2. The Customer must ensure that the equipment is kept safe and dry, is locked up when not attended, and is not stored inside a vehicle.
  3. Any loss or damage is to be reimbursed to the full replacement value.
  4. The Customer must ensure that none of the equipment on hire from the Company is taken outside the Mainland of Great Britain, either any offshore Island or to any foreign Country without the written consent of the Company.
  5. The Customer must ensure that whilst the equipment is in their possession, it is not used for any purpose beyond its capacity of hire or in any manner which is likely to cause damage or deterioration of the equipment.
  6. The Customer must also ensure the equipment on hire remains in their possession, and are not altered or modified in any way by either the Customer or anyone else. Specific attention applies to Cables and Plugs. However, if that is found to be the case upon inspection or return, in such instance the Customer shall be charged the full replacement price.

Liability

  1. The Company shall not be held responsible for any personal injury or damage to the property, or consequential loss which may arise from the improper use of the equipment by the Customer during the period of hire

The use of Equipment and/or Services

  1. Any damage sustained to the equipment on hire or failure of any defect of the equipment on hire, the Customer must notify the Company verbally within 2 days of its occurrence, and must also be confirmed in writing or email within 1 week of the verbal notification. Failure to do so will result in the Customer being charged with the cost of repair and replacement.

Charges

  1. Charges are based upon a 24 hour period of which shall commence in accordance with Clause 3.
  2. If the agreed charges of hire are not settled on the date agreed, the Company will reserve the right to repossess the items and shall not be held liable for any loss or damage that may be suffered by the Customer as a consequence of repossession.

Interest Applicability

  1. Interest shall be payable by the Customer on overdue rentals, and all other sums payable under the contract which remain unpaid in each case from the date due to the date of payment at the default rate. Any interest payable by the Customer on overdue rentals shall commence from the day to day and shall accrue after as well as before any judgement.
  2. Before the issuing of any equipment, the Company may require deposit from the Customer, which may be the sum up to the full replacement cost of the equipment hired. Similarly, the Company at its discretion may require payment of the full hire charge in advance.

If equipment is not booked in time, we cannot guarantee availability of certain products that have been requested, but we will endeavour to supply the equivalence to the same, or as near as possible.
